1 Terms & Condtions of carriage
1.1 The Conditions of Carriage set out customers’ rights, restrictions on those rights and obligations as a customer of Figgy Bus. They are the Conditions under which Figgy Bus carries any person and their property and apply to any journey and any contract to carry any person/s or their property entered into by Figgy Bus.
a) When you confirm a booking and travel on a minibus you enter into a contract with us. The Conditions of Carriage described in this document reflect both our and your legal obligations under that contract.
During the COVID-19 pandemic payment must be made in advance using credit/debit card or BACS via the link we will send to you by e-mail.
Jobs at a future date (>1 month from the day of booking) are required to pay a 20% deposit electronically which is non-refundable. All payments are accompanied by an electronic invoice detailing the balance paid / owed.
b) The hiring of vehicles is governed by the Public Passenger Vehicles Act, 1981, the Transport Act, 1985 and Transport Act, 2000, which provide, amongst other things, for the proper conduct of drivers and passengers, the rules governing drivers’ hours of work and driving and other matters concerning the safety and proper operation of buses and coaches. Hirers are asked not to try to persuade our staff to break these rules, which are governed by law, since by doing so the driver may place in jeopardy his own Passenger Carrying Vehicle Driver’s Licence (and hence his job) and the company’s own Public Service Vehicle Operator’s Licence
c) These Conditions are governed by the laws of England and Wales as applicable. Any Condition subsequently found by a court or competent authority to be invalid does not affect the validity of the others.
d) The terms of these Conditions do not affect your statutory rights.
1.2 STATEMENT OF LIABILITY
1.2.1 We value your custom and are committed to providing you with a high quality and reliable service. However, events outside our normal control may cause us to alter some or all of the journey as necessary. We do our best to overcome delays and to keep you informed but cannot be held liable for any loss, damage, costs or injury that you may suffer as a result.
1.2.2 We cannot accept any liability for any delay, inconvenience or damage which may arise on the date or days of the hire as a consequence of matters entirely outside of our reasonable control such as by way of example unexpected breakdown of vehicles, traffic congestion, diversions or adverse weather conditions which are not as a consequence of our negligence.
1.2.3 Save for personal injury and death caused by our negligence and misrepresentation, we exclude all liability for losses that were: (a) not foreseeable to us and you when the contract was formed. (b) were not caused by any breach on our part; and (c) relate to business losses and/or losses to non-consumers.
1.2.4 We are liable to you for any type of injury caused by our negligence. You are liable to us and / or other passengers for any injury, damage or loss caused by you or by any items that you bring on board with you including animals.
1.3 YOUR CONDUCT
1.3.1 It helps us to provide a pleasant travel environment if customers are respectful of other passengers and our drivers. The hirer undertakes to be responsible for the orderly behaviour of all members of the party and for ensuring that their conduct shall not be such as to cause annoyance to the public. Otherwise you may be refused travel or asked to leave the vehicle.
1.3.2 In particular, you must not:
a) Smoke at any time – this includes cigarettes, e-cigarettes, cigars, pipes and means of lighting them.
b) Behave in any way which causes offence to other passengers or our drivers – this includes verbal or physical abuse; being under the influence of alcohol, drugs or solvents; wearing soiled or dirty clothing; putting your feet on seats; consuming and playing personal or other music systems too loudly.
c) Fail to maintain social distancing in place during COVID-19 or following the cab-based signage / the drivers’ instructions.
d) Bring or consume any item of food or drink on the vehicle in a way that causes offence, hazard or is likely to soil the seating.
During the COVID-19 pandemic no food or drink is permitted in vehicles.
e) Where the vehicle has been soiled due to your negligence, misconduct or any default or that of any of the passengers carried and which as a result requires us to perform extraordinary cleaning to the vehicle to render it fit for hire, you shall be responsible for paying to us the reasonable costs we incur for such cleaning services.
f) Where the vehicle has been soiled or contaminated due to the onset of illness and you feel you may have symptoms of COVID-19 please inform the driver immediately in order for the situation to be risk assessed.
g) You will be asked at the time of booking if you have any COVID-19 related symptoms. Passengers are not permitted to travel in public services vehicles / taxis if they either have any of the symptoms of COVID-19 or are in a self-isolation period. You must inform us if your health changes after you have made the booking.
h) You must not deliberately interfere with, misuse or damage any equipment or fittings or signage on the vehicle. In the event that you cause wilful damage to any of our vehicles we reserve the right to seek from you all reasonable costs we incur in rectifying any damage caused by you and reserve the right to report the matter to the police with a view to prosecution.
i) Take part in any criminal or legally prohibited activity.
1.4 LUGGAGE
1.4.1 Items of luggage or other personal belongings are carried at the driver’s discretion and the owner’s risk. You are responsible for the safe stowage and handling of all items during your journey. We must be informed at the time of booking of larger or bulky items that cannot be safely stowed at your seat such as suitcases, pushchairs, wheelchairs, Motability scooters and sporting equipment and of any special assistance you may require. Larger items may be transported in a trailer where required.
1.4.2 Luggage cannot be stowed in the aisle or at the emergency exits.
1.5 LOST PROPERTY
1.5.1 Please hand any item of lost property that you find on our vehicles to the driver. We will do all we reasonably can to locate the owner and return it to them. We hold lost property for one month apart from items that are either perishable or become objectionable and need to be disposed of sooner. During the COVID-19 pandemic, simply alert the driver to the whereabouts of the item so it can be safely bagged and stored for collection.
1.6 CCTV AND DATA PROTECTION
1.6.1 CCTV is sometimes used on our vehicles to record images and, in some cases, sound for security and crime prevention purposes. This data may be passed to the police and prosecuting authorities to provide evidence in legal proceedings. Our CCTV equipment and systems are operated in full accordance with the Data Protection Act 1998 and other relevant legislation.
